The Authority must issue a notice of non‑compliance to a licence holder where a notice under section 192 has issued or the Authority has made a decision under section 197(2)(c) and it is satisfied the licence holder has contravened or is contravening the relevant obligation. The notice must state the Authority's satisfaction and reasons, and, where the contravention so merits, either contain an advice, caution, warning or reprimand or specify one or more conditions to address and mitigate the contravention. The notice must also state the licence holder's entitlement to appeal under Part 9 and the period for bringing that appeal.

A condition specified takes effect on expiry of the appeal period if no appeal is brought, or, where an appeal is made, when the appeal against the imposition has not been allowed. Where a notice of non‑compliance contains no advice, caution, warning, reprimand or condition, the Authority may apply to the Circuit Court under section 194 for suspension or revocation of the gambling licence on the later of the expiry of the appeal period with no appeal or after an appeal has not been allowed.
