A licensee holding a gaming licence may apply to the Authority to vary the relevant game(s), to vary the number of gaming machines used to provide relevant game(s), or to commence providing relevant games via gaming machines where not originally intended. A licensee of a non-once‑off lottery licence may apply to vary the lottery products or activities. A betting licence holder may apply to vary the event(s), series or class of events for which pool betting is authorised or to add pool betting for events not originally included.

Applications must be made in the form, manner and with the information and supporting documentation specified by the Authority, must specify proposed gaming machine numbers where relevant, and must be accompanied by any prescribed fee. The Authority may grant a variation if satisfied it is appropriate having regard to the supplied information. If the Authority refuses, it must notify the licensee within 14 days, stating the reasons, that the licensee may appeal under Part 9, and the period for bringing an appeal.
