Where Article 27 early-intervention conditions are met for a Union parent, the consolidating supervisor shall notify the EBA and consult the competent authorities in the supervisory college before deciding. After notification and consultation the consolidating supervisor shall decide whether to apply early-intervention measures, taking account of effects on group entities in other Member States, and shall notify the EBA and the college. Where a subsidiary is concerned, the competent authority supervising that subsidiary shall notify the EBA and consult the consolidating supervisor; the consolidating supervisor may assess group impact and must communicate that assessment within three days, after which the competent authority shall decide and notify the EBA, the consolidating supervisor and other college members.

Where multiple competent authorities intend measures in the same group, the consolidating supervisor and relevant authorities shall jointly decide within five days whether to appoint a single temporary administrator or to coordinate measures; the joint decision must be reasoned and provided to the Union parent. The EBA may assist on request. In the absence of a joint decision within five days authorities may take individual decisions. A competent authority that disagrees may refer the matter to the EBA under Article 19(3) of Regulation (EU) No 1093/2010; if referred, authorities shall defer and follow any EBA decision, with the EBA to decide within three days. Decisions must be reasoned and take account of views expressed and potential effects on financial stability.
