Regulation 57 Exchange of information on penalties and maintenance of central database by EBA
(1) Subject to professional secrecy requirements, the Bank shall inform the EBA of all administrative penalties, including all permanent prohibitions, imposed under Regulations 54 and 55 including any appeal in relation thereto and the outcome thereof.
(2) Where the Bank assesses good repute for the purposes of -
(a) the Act of 1971,
(b) the Act of 1989,
(d) Regulations 79(1) and 109,
it shall consult the EBA database of administrative penalties.
(3) The Bank shall check, subject to national law, the existence of a relevant conviction in the criminal record of the person concerned and for those purposes, information shall be exchanged in accordance with Council Decision 2009/316/JHA of 6 April 2009 [OJ No. L 93, 07.04.2009, p. 33] and Council Framework Decision 2009/315/JHA of 26 February 2009 [OJ No. L 93, 07.04.2009, p. 23].
