Article 1 Subject matter and scope

1. This Directive lays down rules and procedures relating to the recovery and resolution of the following entities:

(a) insurance and reinsurance undertakings that are established in the Union and fall within the scope of Article 2 of Directive 2009/138/EC;

(b) parent insurance and reinsurance undertakings established in the Union;

(c) insurance holding companies and mixed financial holding companies that are established in the Union;

(d) parent insurance holding companies in a Member State and parent mixed financial holding companies in a Member State;

(e) Union parent insurance holding companies and Union parent mixed financial holding companies;

(f) branches of insurance and reinsurance undertakings that are established in a third country and that fulfil the conditions laid down in Articles 75 to 80.

This Directive also lays down rules and procedures relating to essential service providers where the relevant insurance and reinsurance undertakings enters into resolution.
