Where a gambling licence is held in an individual’s sole name, a relevant applicant may apply to the Authority within 21 days for transfer if the licensee dies or ceases to be an officer or member of an unincorporated body by reason of which they held the licence. Applications must be in the form and with the supporting documentation the Authority specifies. The Authority must notify its decision within 7 days and, if transfer is permitted, include the information in subsection (6); if refused it must confirm appeal rights under Part 9, the appeal period, and, where applicable, include the information in subsection (5).

Subsection (5) provides that where death occurs and transfer is refused the licence remains in force and the relevant applicant is deemed the licensee until the appeal period expires; if no appeal is brought the licence is revoked at expiry, and if an appeal is refused the licence is revoked on refusal. Subsection (6) provides that where transfer is permitted or an appeal is allowed the licence transfers to the relevant person for the remainder of its term, the relevant applicant is deemed to have been the licensee from the date of the triggering circumstances, statutory references to ‘licensee’ include the applicant for that period, first renewals are treated under section 112, 118 or 125 as applicable, and the Authority must update the register as soon as practicable.
